Background
To ensure the safety of toddlers from drowning, on December 1, 2019 laws to improve swimming pool and spa safety came into effect in Victoria. It is now mandatory for owners of land where a swimming pool or spa is located to register their pool or spa with the relevant council, and ensuring owner pool and spa fence barriers are meet Australian Standards.

The new laws apply to swimming pools and spas that are capable of holding more than 300 mm (30 cm) of water. This includes permanent pools, above ground pools, indoor pools, hot tubs, bathing or wading pools and some relocatable pools.
​
These changes require owners to register their pools and spas with their local council with a one-off fee of up to $79.
Owners who have not registered will receive an on-the-spot fine of $330.
Once registration is complete, the council will inform the pool owner of the date by which they must organise their first inspection and certification of their barrier.
In addition, owners must have a registered building surveyor or inspector certify the continuing compliance of their safety barrier every four years.

In a perfect setting, the independent building inspector would inspect your barrier deem it compliant and issue you a certificate of barrier compliance (A). However, it has been reported by Swimming Pool and Spa Association of Victoria (SPASAVIC) that over 98% of pool and spa barriers have failed upon first inspection.

As most barriers fail their first inspection, a second inspection (B) is immediately locked in, 60 days to rectify after the first inspection.
​
If you your pool or spa barrier fails the inspection under Building Regulation 147ZF(c) a notice will be sent to your council and you a fine of up to $385.06 (C) will be imposed.
The total cost before any rectification works is approximately $885.06. This is broken down below in out table.
